‘Grandma Got Run Over’ Copyright Fight To Continue Into Spring
Christmas may be over, and Santa Claus may have retreated to his North Pole hideout, but the fight over a beloved holiday novelty song will keep raging into the spring.

Last week, a federal district court judge refused to dismiss copyright claims over a version of “Grandma Got Run Over By A Reindeer” uploaded to YouTube, The American Lawyer reported. The infringement claim was brought by Elmo Shropshire, who recorded the original version of the song in 1979, against Aubrey Canning Jr., who uploaded a version of the song to YouTube four years ago.

According to the most recent ruling by Judge Lucy Koh, Canning posted a video to YouTube that “combined Christmas-related pictures with audio of a Canadian musical group, ‘The Irish Rovers,’ singing the Grandma song.” Shropshire asked Canning to pay for use of the song or remove the video, but after the video was removed and reinstated by YouTube, Canning claimed that he did not copy “any original work” and said his video was fair use, Courthouse News Service noted.
So, a guy in Canada is being sued in the U.S. over ... a vid?
