Even putting the inherent creepiness aside, that much bare skin in servers delivering hot food has to be unsafe work clothing. I mean, what if you stumble with a tray? The food will splash all over the bare belly and legs. There's a reason long aprons are popular as server attire.

It took a bit of digging, but waitstaff are covered by OSHA, and their database shows several actions brought against Hooters (a random example). Unfortunately, chances of someone lodging a complaint before someone gets injured strike me as low :/

I can't figure out how they get past the EEOC. I know there was a discrimination lawsuit filed once; I heard maybe it settled? No idea.

Perhaps their setup works like with strip dancing or modeling or such where looks are integral to the business and thus it's okay that they only employ young, pretty women with good cleavage?

That's unlikely but possible. In the early days of our antidiscrimination laws, businesses always made that argument and the EEOC rejected them pretty firmly, I doubt it would work for restaurants.

Aha! Here's what happened with the EEOC. I knew there had been a ridiculous settlement, and there was - that men can occupy other positions in no way is a remedy to the discrimination. (What if all bartending positions are filled, but they need waitstaff, and a man is turned away?) That would ordinarily be blackletter law - I gather than the EEOC was basically intimidated by politics/bad press.

The weirdest discriminatory hiring I've seen was done by the ice cream parlor nearby, who were looking for part time serving staff and a driver with a flyer in their shop, and specifically wanted only women to apply to scoop ice cream and only men for a driver. And they don't even have a any breast gawking business model as excuse. At least that makes sense from a business' side. Whereas this made no sense at all. Unfortunately they have the tastiest ice cream and best selection in my area, so I don't even boycott them, but seriously, it was so wtf?
